The Terms of Use (“TOU”) is an agreement between Cube Financial Group (ABN 65 074 796 348, ASIC License No: 166356) (“CFG”) and the user (“you”). It stipulates the conditions by which you can access and use the information provided on our network of websites.

The “Services” Cube Financial Group (“CFG”) provides to you are subject to the following Terms of Use (“TOU”). CFG reserves the right to amend or change the TOU at anytime without notice.

DESCRIPTION OF SERVICES, ACKNOWLEDGEMENT & ACCEPTANCE OF TERMS OF USE
Through its many websites including without limitation, www.cubefinancial.co.nz, www.cubefinancial.com.au (collectively “Sites”) CFG provides you with access to several resources including product information, software download sections, schedule information, investment information, market information and community information (collectively “Services”). Your access to these services, use of, linking to the site, use of software or downloading software from the site constitutes your agreement to be bound by the terms, conditions, notices and disclaimers contained in this document and elsewhere on CFG network of “Sites”.

USE LIMITATION AND OWNERSHIP
The CFG Services, including without limitation all information, text, materials, graphics, software, tools, results derived from the use of software and tools, advertisements, names, logos and trade marks are protected by copyright, trade mark and other intellectual property laws unless expressly indicated otherwise on the Site. Further, the Services and content are for your personal and non-commercial use. You must not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or content, except as is expressly indicated on the site.

You may view the Site using your web browser and save an electronic copy, or print out a copy, of parts of this web site solely for your own personal use, information, research or study. You must not use the Site or the content in any manner or for any purpose, which is unlawful, or in any manner with violates any right of CFG or related companies or which is prohibited by the TOU. You must indemnify and hold harmless CFG or its employees and keep them indemnified, against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from:

(b). reliance by you on any information obtained through the Site; or
(c). your access and/or use of the Site; or
(d). reliance upon or use of any Content by any person accessing any Content through your web site.

Any reproduction or redistribution of Software not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent of the law.

MARKET INFORMATION DELAY
This information is live and available to CFG members only. Unless stated otherwise, price information provided on the Site is delayed by at least twenty (20) minutes.

Important: Unless stated otherwise other information, in particular the edited text of company announcements, is delayed by at least twenty (20) minutes and could be well behind the actual release time of the full company announcement.

MEMBERSHIP ACCOUNTS, PASSWORD, & SECURITY
If any of the Services offered by CFG requires you to open an account, you must provide us with current, complete and accurate information as prompted by the applicable registration form. You may also choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. You are entirely responsible for any and all activities that occur under your account. You agree to notify CFG immediately of any use of your account which is unauthorised or any other breach of security. CFG will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by CFG or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder. CFG may terminate your access to the Services at anytime without notice to you, if it deems necessary.

These General Conditions are governed by, read and enforced in accordance with the laws of New South Wales, Australia. Disputes arising from these General Conditions are subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
